Terms of Service

Please read these terms and conditions carefully before buying device(s). You should understand that by submitting an order, you agree to be bound by these terms and conditions.

When we refer to “we,” “our,” or “us” in this policy, we are referring to HP Technologies Ltd the company which processes your order. Trading as PhoneBox.

1 Selling a Phone/Device to Us

By submitting a sales order through our site (“phonebox.co.uk”) you warrant that the device(s) comply with these terms.

If you have a PIN or Password on any of your items you should remove this before sending.

Please remove any Network, eSIM, Apple iCloud, Google or Brand specific accounts, as well as your Password.

Each device sold by you should match the make, model and condition stated when registering your sales order. It must also meet the following conditions:

The device must turn on and off.
The device must be not have any missing parts or components.
The battery must be included.
The device must not be bent, crushed or liquid damaged.
The device must be original and meet the manufacturer’s original specifications.

1.1 Grading Phones/Devices

No device is ever the same so grading does vary from model to model, depending on the damage and condition.

Mobile phones/devices not listed on our website will be automatically recycled where possible, subject to these Terms. Such mobile phones/devices cannot be returned under any circumstances. Please ensure you are happy to send such mobile phones/devices to us for recycling only. You will not receive any payment for such mobile phones/devices. We accept the return of mobile phone/device boxes, battery chargers and mobile phone/device accessories but they do not increase mobile phone/device value and will not be returned if requested.

Do not include more than two mobile phones/devices in one package. If you require an additional sales pack please contact our Customer Services. Our Customer Service details are set out at the end of these terms and conditions.

For ad hoc damage and anything which affects our ability to refurbish or recycle your sales order there will be a reduction in price to reflect this damage. In these cases PhoneBox will have the final decision on all device values.

1.2 Phone/Device Specification and Condition

Each mobile phone or device sold should match the make and model in the sales order, and meet one of the following conditions:

Condition – Good
Each device should:

Handset powers on and is fully functional – free from any faults
LCD is original or a genuine OEM replacement – No delamination, pressure marks/white spots, discolouration or dead pixels. No screen burn. No screen lift.
Excellent cosmetic condition (FC/CE Marks fully visible)
Housing is original or a genuine OEM replacement – No delamination/peeling. No cracks in the case, home button, rear cover/glass, camera lens. No chips and is not bent.
Battery health is good – 80% or greater AND less than 500 full charge cycles.
Home button, Touch ID, Face ID, NFC all function correctly.
Handset has not been modified – Jail Broken or rooted.
Where applicable stylus must be included.
No liquid damage.
No visible scratches on the screen from 8 inches away

Condition – Poor
Each device should:

Handset powers on – is functional but can have minor faults.
Minor faults include – Stiff power button, mute button, quiet microphone or earpiece.
LCD is original or a genuine OEM replacement – Heavy scratches allowed. No delamination, chips or cracked glass are allowed
The LCD cannot have – delamination, chips/cracked glass, bleed, pressure marks/white spots, discolouration or dead pixels. No screen burn. No screen lift.
Housing is original or genuine OEM replacement – No delamination/peeling. No cracks in the case, home button, rear cover/glass, camera lens. No chips and is not bent.
Battery health is good – 80% or greater AND less than 500 charge cycles
Home button, Touch ID, Face ID, NFC all function correctly.
Handset has not been modified – Jail Broken or rooted.
No liquid damage.
Visible scratches from 8 inches away

Condition – Broken
Each device should:

Handset has one or more minor functional faults.
Minor faults include – Stiff power button, mute button, quiet microphone or earpiece.
Heavy wear and tear acceptable – LCD is cracked but no bleeding, pressure marks, white spots discolouration or dead pixels. Screen must be original or an original replacement and must switch on
Housing is original or genuine OEM replacement – No delamination/peeling. No cracks in the case, home button, rear cover/glass. No chips and is not bent.
Home button, Touch ID, Face ID, NFC all function correctly.
No missing parts
Handset has not been modified – Jail Broken or rooted.
No Liquid damage.
Must be removed from any iCloud/Samsung/Google accounts.
Battery is in poor health – below 80% OR more than 500 charge cycles

1.3 Pricing

Prices offered on our website are subject to change at any time without notice. Mobile phone/device values may change from day to day which means that if you check the value of your mobile phone/device on any given day but do not place a sales order, you may be given a different value for the same mobile phone/device at a later time. This does not affect any other provisions in these terms and conditions.

Any special offers on mobile phone/device values are subject to particular terms which we may impose and may be varied or withdrawn at any time and without notice. Values are shown and payments are made in pounds sterling. Each mobile phone/device is processed separately even if included in a multiple mobile phone/device sales order.

When your sales order has been placed, the prices quoted are guaranteed for 14 days. If your phone/device is received after 14 days from the sales order placed date the updated, current prices will apply. PhoneBox will have the final decision on all device values.

1.4 Testing for Incorrect Information

We test each mobile phone/device for compliance with our terms and conditions. We also check that the mobile phone/device is not red flagged (see below) according to Phonecheck details. Tests are carried out prior to and are the conditions for, payment. We may stipulate additional tests as we reasonably determine.

As mobile phones/devices can look similar, customers sometimes incorrectly identify them. If we find that the model you send is not as referred to in your sales order, we will email a value for the actual mobile phone/device, confirming the model.

We also test the device for the network it is locked to. In some cases your device will receive a reduction if you have selected the incorrect network referred in your sales order.

You can choose to continue the sale for the revised value or decline it. If you decline it, we will return the mobile phone/device. The sale will not progress and our contract with you will terminate. To accept or decline a revised value, log on to your account where you will be given the revised value and be asked to either proceed or decline the revised value. If you do not respond within 5 (five) days, starting on the day on which we email the revised value, we will automatically process your sale after that time, using the new price. If you have queries about how models are identified, contact our Customer Services. Our Customer Service details are set out at the end of these terms and conditions.

1.5 Testing for Damage

Where possible, we offer a value for a damaged mobile phone/device but we are not obliged to do so nor to purchase any damaged mobile phone/device.

If we determine your mobile phone/device is damaged, we will value the damaged mobile phone/device to take account of the damage and send a revised value by email.

In some cases, values will be zero if mobile phones/devices are beyond economical repair or have multiple faults (e.g. water damage and cracked LCD screen). In these cases PhoneBox reserves the right not to offer a value, but to return the device to you, thereby terminating the contract.

A revised value will only be given once the mobile phone/device has been tested or inspected. You can decide whether to continue with the revised value sale or whether to decline it in which case, we will return your mobile phone/device within 14 days, the sale will not continue and our contract with you will terminate.

To accept or decline a revised value, log on to your account where you will be given the revised value and asked to either proceed with the sale or decline the revised value. If you do not respond within 5 (five) days, starting on the day on which we email the revised value, we will automatically process your mobile phone/device sale after that time using the new price.

Mobile phones/devices in pieces or parts or mobile phones/devices which have no value will not be returned and we will recycle them.

1.6 Lost or Stolen Red Flagged – Mobile Phones and Devices

We will check the status of all mobile phones/devices received against the National Phonecheck database.

If you are advised that your mobile phone/device has a red flag against it you will be advised of the procedure required by email from us. The purpose of the quarantine period is to allow the rightful owner the opportunity to have the red flag removed in order that the mobile phone/device can be processed appropriately.

If, during the quarantine period the red flag is removed, your mobile phone/device will be processed and paid for in accordance with these terms and conditions and will not be returned.

However, if after the quarantine period has expired the red flag has not been removed then we are required by law to dispose of it and you will not receive any payment. UK legislation states that we cannot under any circumstances return the mobile phone/device during this 28 day period unless the red flag has been removed. If we become aware of any issues you will be required to co-operate with the authorities and we reserve the right to withhold or cancel the payment.

If you have received payment from us for a mobile phone or device which we subsequently become aware of an issue relating to ownership, you agree to immediately reimburse us in full, within 3 business days following a written request by us, for any such payment pending an investigation by us or any law enforcement body into ownership of the device or mobile phone.

We shall be entitled to set-off any sums properly due and owing to us under any contract made between you and us incorporating these terms and conditions against any sums owed by us to you under the same or any other contract between us. We will inform you in writing of any set-off carried out by us pursuant to this provision.

1.7 Activation Locked Devices

If your device(s) is activation locked we will contact you with instructions on how to remove the lock. If you fail to respond to this email within 7 days we will return the device. If the delivery failed on the first attempt we will contact you by phone and email before returning for a second time. If the second attempt is failed you the customer must contact phonebox.co.uk to arrange a third delivery at your own cost. If there is no contact for 7 days we will automatically process the sales order at the amended price for Activation Locked phones which is £0.

1.8 Data Risks and Precautions – Important

Please remember that by sending your device to us, you agree to release us from all and any claims, losses or damages with respect to the device, any data stored or contained therein or on any media used in conjunction with the device (whether in the form of personal details, SMS, photos, games, songs or other data (“Data”)). We accept no responsibility in relation to the security, protection, confidentiality or use of such data and it is your responsibility to ensure so far as practicable that Data is removed from the device prior to you sending it to us.

Although in our experience the risk of Data left on your device being accessed by us or by any third party to whom we subsequently sell the device are very low, we draw to your attention the following points which will help you decide whether to accept the risk of selling us a device which may contain accessible Data.

If your device is functional, we strongly advise that you delete all personal data from the device prior to sending it to us. Please follow your phone/device manufacturers guidelines, for a step-by-step instructions on how to delete personal data from your device.

If your device is non-functional and has a “remote wipe” function, then we strongly advise that you attempt wiping the device prior to sending it to us.

If your non-functional device cannot be data wiped but has a PIN lock (a password or combination which needs to be entered to access the phone when switched on) then this will block third party access and mean that anyone repairing the device will be required to return the phone to its factory settings, in the process wiping the Data held on the device.

Please note it may not be possible to delete Data directly from a non-functioning device. If you send us a non-functioning device you are therefore accepting the risk that it may still contain Data which may be accessible to any person who repairs the phone. This may include third parties to whom we have sold the device for spare parts.

Please note that while (as stated above) we do not accept any liability in respect of the security, protection, confidentiality or use of Data included on any device, as a matter of practice we do not transfer any device to any third party except on terms which require them to wipe that Data.

1.9 Payments

Our payments terms are bank transfer only. When we receive your sales order, we will check that it is complete, and that it meets our terms and conditions. Providing it does, we will send payment to the account details outlined by yourself.

Under no circumstances will payment be dispatched before we receive and process your mobile phone/device. We will pay by faster payment transfer directly into your account on the same day we process your device.

If your payment date falls on a weekend or public holiday payment will be made on the next working day. Payment processing depends on third parties which we do not control.

Please Note: We will not be liable if you fail to receive a payment or suffer a loss (including, without limitation, if a payment is sent to an incorrect account) as a result of your failure to input all payment and other details correctly, completely and accurately. Payment can only be made to the name, address, payment and account details provided upon registration and incorrect details may result in delay or non-payment.

1.10 Rejected Offers

If you reject an amended offer for your sales order we will return your device/s upon receipt of a £10 return charge (please see below). Please allow 3-5 working days. If the delivery is failed on the first attempt we will contact you by phone and email before returning for a second time. If the second attempt is failed you the customer must contact PhoneBox.co.uk to arrange a third delivery at your own cost. If there is no contact for 7 days we will automatically process your payment at the amended price. Please note if trading in a device where the correct condition category has not been chosen and the amended price has been declined, the customer will bare the cost of £10 for postage back to themselves.

1.11 Postage and Returns

You send your mobile phone/device to us at your own risk. Please ensure that you are happy to send the device to us in accordance with these terms and that it is within your rights to do so.

We will send you a reminder by email if we have still not received your mobile phone/device within 7 & 14 days of your sales order. We will not be liable if the mobile phone/device is subject to loss or damage before receipt at our warehouse. Equally, if for any reason your mobile phone/device is returned to you, you retain responsibility for risk in the mobile phone/device and we shall not be responsible for any damage in transit.

We do not receive deliveries on weekends and bank holidays. We strongly recommend that you pack the mobile phone/device carefully to minimise risk of damage. We use Royal Mail as the carrier for our free postage services in most cases and this regulates how you must pack and send your device(s).

Royal Mail regulations state that you must pack the phone in a strong, rigid package, ensure that it cannot move or be turned on during transit. For example using a cardboard box and encasing each device in a material which prevents movement in transit e.g bubble wrap and then packing out the box should be suitable. In addition you can only pack a maximum of 2 devices in any one package. If you have more than 2 devices to send then please contact Customer Service. Our Customer Service details are set out at the end of these terms and conditions.

The label we provide to send in your device(s) must be used on one package only – do not use the label on more than one package. You must take the package to a Post Office and hand it in at the counter where you will receive a 13 digit tracking number and receipt of postage.

The label and tracking service we provide with Royal Mail is insured up to the value of £100 for the package. If you require additional insurance then best option is to arrange and pay for your own service with Royal Mail or another carrier which provides the level of insurance you feel is suitable.

If your mobile phone/device is lost in the post we will advise you how you might claim against the Royal Mail but we cannot guarantee this to be successful.

If we receive a damaged package, the package and mobile phone/device (if we received it) will be returned to you so that you may claim for the loss directly from Royal Mail if you wish. By sending the package back to you we do not guarantee that the claim will be successful and we will not have any liability for any claims which are refused by external parties.

2 Buying a Device from Us

By submitting an order through our site (“www.phonebox.co.uk”) you warrant that the device(s) comply with these terms.

We reserve the right to refuse service to anyone for any reason at any time.

You understand that your content (not including payment information/ credit card etc), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

You agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without express written permission by us.

2.1 Pricing

The prices of the products will be as quoted on our site.

Prices for our products may change, but changes will not affect any order which we have confirmed with a Dispatch Confirmation.

The price of the products includes VAT (where applicable) at the applicable current rate chargeable in the UK for the time. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.

The price of the products does not include delivery charges. Our delivery charges are as quoted on our site from time to time.

It is always possible that, despite our reasonable efforts, some of the products on our site may be incorrectly priced.

If we discover an incorrect price, we will inform you and will give you the option of continuing with your order based on the correct information or cancelling the order. We will not process your order until we have your instructions. If we are unable to contact you, we will treat the order as cancelled and notify you in writing.

Please note that if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the products to you at the incorrect (lower) price.

2.2 Price Match Promise

Our Price Match Promise has the following terms and conditions:

Refurbished items:

The product and any included accessories must be identical on the competitor site in condition, specification and any included warranty to the product on our site ( www.phonebox.co.uk ).
We will match high street retailers and internet stores, but the product must be available online from their own web site and prices publicly available to all customers.
We must be able to confirm that the item is available on the competitor site and can be delivered in the same timeframe. Any shipping charges will be included in any price comparisons.
Prices on auction or shopping sites such as Amazon, eBay and Back Market are excluded.
Any Price Match offer is only valid on the working day we issue it and you must order on the same working day as the offer is made. Any Price Match offer expires at the end of the working day it is made.
A Price Match offer cannot be used in conjunction with any other offer or discount.
We are unable to match any offer code discounts on refurbished items or items purchased using finance.
We reserve the right not to match the price if the conditions above are not met and our decision and any offer is final. We reserve the right not to price match at any time.

To request a Price Match:

Get a link for the product on our competitor’s site that you want us to match against.

Send both links to us via email at [email protected] along with your contact details including telephone number where we can contact you.

2.3 Buying – How the Contract Is Formed Between You And Us

Our site is only intended for use by people registered with us and resident in the UK. At our complete discretion we may accept or reject orders from people outside of these territories.

After you place an order with us online, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted.

We will confirm our acceptance to you by sending you an e-mail that confirms that the products have been dispatched (Dispatch Confirmation). The Contract between us will be formed when we send you the Dispatch Confirmation.

If we are unable to supply your products, for example because those products are no longer available or because of an error in the price on our site, we will inform you of this by e-mail and we will not process your order. If you have already paid for the products, we will refund you the full amount as soon as possible.

If an order is refunded we will not accept any liability for any bank charges which may have been incurred.

The contract between you and us is binding on you and us and on our respective successors and assigns. You may not transfer, assign, charge or otherwise dispose of a contract, or any of your rights or obligations arising under it, without our prior written consent We may transfer, assign, charge, sub-contract or otherwise dispose of a contract, or any of our rights or obligations arising under it, at any time during the term of the contract.

2.4 Returns Policy

Our return policy lasts 30 days and starts from the date of receipt by you. The product will be eligible for return and refund when received by us in the same condition as issued and unused. All accessories issued with the product including any free add-on products must also be returned in the same condition.

Where there is only 4 days left of said period you will have 5 working days to return the unit/s to us once we have been notified. Units will not be liable for return outside of this period. Where a product has been either damaged or has software encryption it will not be eligible.

Please do not send your purchase back to the manufacturer.

To return an item, please email customer service at [email protected] to obtain a Return Merchandise Authorisation (RMA) number. After receiving an RMA number, place the item securely in its original packaging, and mail your return to the following address:

Please note, you will be responsible for all return shipping charges. We strongly recommend that you use a trackable method to mail your return as we will not cover any lost or damaged device costs the customer will incur and is liable for these costs.

Please remember to remove the following before returning your device:

All security and parental locks
Your SIM cards
Memory card (if applicable)
Your iCloud / Samsung / Google account
Backup and remove any personal data from your device.
Failure to do so will lead to a delay in the processing of your return and/or prevent it from being processed.

There may be occasions where a partial refund may be provided if your returned product does not meet these terms, or your return may be rejected and your device returned to you. These are evaluated on an order-by-order basis.

2.5 Refunds (if applicable, subject to Returns Policy)

Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.

If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.

2.6 Late or Missing Refunds (if applicable)

If you have not received a refund yet, first check your bank account again.

Then contact your credit card company, it may take some time before your refund is officially posted.

Following this contact your bank. There is often some processing time before a refund is posted.

If you have done all of this and you still have not received your refund yet, please contact us at [email protected].

2.7 Exchanges (if applicable)

We replace items only where they have been supplied defective or damaged. If you wish to exchange your product, please contact us within 24hrs of receipt Mon – Fri, 9am-5pm. Email [email protected].

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

2.8 Shipping and Delivery

We always try to process all orders placed before 2pm the same working day.

We use the most efficient and reliable postal services and couriers to get your orders to you, such as Royal Mail, Parcelforce and DPD to be with you within 2-4 working days*.

If you would like your delivery quicker than this, then we can expedite your delivery* (1-2 working days for orders placed before 2pm otherwise 1 additional working day will apply) subject to an additional charge which can be selected at checkout.

Please note if trading in an item, our postage packs only cover you to £100. Should you wish to ensure the full amount of your device, please use your own alternative delivery method.

If your order is delayed, please contact our customer service team via email [email protected] and we will provide you with an update.

Please Note:

We cannot guarantee deliveries for Outer UK Mainland will be delivered within the same time frames.
We are currently not able to ship to BFPO address.
If items are sent via courier or signed-for services, goods will need to be signed for. To make this easier, please provide an address where someone will be available to sign for any goods.
In exceptional circumstances we reserve the right to use alternative couriers or delivery methods.

*Please note this is for deliveries within the UK mainland. UK mainland excludes Northern Ireland, Eire, Scottish Offshore, Scottish Highlands, Channel Islands, and Isle of Man. If you are unsure whether delivery restrictions apply to you, please contact our customer services team who will be happy to help.

2.9 International delivery

Unfortunately, we do not deliver to addresses outside the UK.

You may place an order for products from outside the UK, but this order must be for delivery to an address in the UK and you will be subject to a delivery fee.

2.10 Refurbished Device Warranty

All our refurbished devices come with our standard 12-month warranty when purchased from this site (www.phonebox.co.uk ). If your product is reported as faulty after the first 30 days from the purchase date. We will cover either its repair or replacement for a period of 12-months following the purchase date.

Your device is covered against defects in materials and workmanship when used in accordance with the manufacturer’s user manual, technical specifications and any other manufacturer guidance released from time to time, for a period of 12-months from the date that you purchased your device except for the battery which comes with a 3-month warranty. This is called the “warranty period”.

If there is a defect or fault with your device during the warranty period, we will repair or replace your device (at our discretion). These are the only remedies available under this warranty and you will not be able to choose whether your device is repaired or replaced. This warranty only applies to consumers and business customers in the UK who have purchased a pre-owned (including second hand) device directly from our website (www.phonebox.co.uk )

You cannot benefit from this warranty if you:

have accidently or wilfully damaged the operational behaviour of the device; this may be via soft / hard impacts or liquid damage.
have bought a product other than that identified by its IMEI.
Installed non-authorised, malicious or Beta software.

Please note all IMEI’s are recorded. The warranty only covers your device itself and it does not cover:

Any accessories that came with your device including, but not limited to, the charger, cable, and case.
Battery life – our acceptable minimum battery health percentage is 80% of the manufacturer’s original quoted capacity.
Faults or damage due to normal wear and tear through use of the product and/or accessories
Software, even if installed on the device when purchased. Please refer to the licensing agreement which is given in respect of software by the software developer for details of your rights in respect to any software.
IP67 Rated and Water resistance devices – where a device carries an IP rating, water damage will NOT be covered for any device purchased on our website ( phonebox.co.uk )

If we find that there is a fault or defect and you are covered by this warranty, we will either:

repair your device using new or used parts;
replace your device with a pre-owned device

We may install system / software updates onto your repaired or replaced device, and you will be unable to revert to an earlier version of the system / software once this has been done.
You will be responsible for reinstalling all software programs (including apps), data and information onto your repaired or replaced device.
Some apps may not be compatible with the system / software update we have installed, and we will not be liable where any of the apps you have downloaded cannot be reloaded onto your repaired or replaced device.

Where we replace your device:

The replacement device will be owned by you and we will retain the original. You will not be entitled to ask for the original device to be returned to you; and any remaining time left on your 12-month warranty will be transferred to your replacement device, and if there is less than 3 months remaining on the warranty, we will extend the warranty so that you will have 3 months’ warranty on the replacement device.

Only defects and faults that relate to the materials or our workmanship are covered by this warranty. This means that you cannot claim under this warranty for:

damage caused by your mishandling or misuse, neglect, negligence, tampering, or unauthorised adjustments (including “jailbreaking”, Non-authorised, Malicious or Beta software)
accidental damage or any damage caused by liquid, fire, or any other event outside of our control.
your use of the device contrary to the manufacturer’s user manuals, technical specification, or guidance
damage caused in the course of any work carried out by third parties or yourself (e.g. where you have your device screen replaced by someone other than us). Authorisation must first be granted should you wish work done by representatives from the manufacturer or Manufacturer Authorised Service Providers. Please note that if you try to, or engage any third party to, carry our repairs or replacements to your device, or open your device, this warranty will be void.
damage due to usual wear and tear or the natural ageing of your device
cosmetic damage including, but not limited to, dents, scratches, chips, cracks, or snaps in external plastic on ports.
any damage to your phones/devices protective coating (which is designed to diminish over time)
damage caused by use of the device with any other product (e.g. device speakers)
loss or theft of your device or any loss or damage to data on your device
You will not be able to claim under this warranty if the serial number on your device has been removed or if we know, or reasonably believe, your device to be stolen (based on information provided by law enforcement authorities).

To claim on your warranty, please email customer service at [email protected] to obtain a Return Merchandise Authorisation (RMA) number indicating that you wish to claim under warranty. After receiving an RMA number, place the item securely in its original or suitable alternative packaging, and mail your return to the following address:

2.11 New Product Warranty

We only supply our services and purchase or recycle mobile phones/devices for consumers and we have no liability to you for any loss of profit, loss of business, business interruption, loss of business opportunity, loss of data; loss of use of money; losses which you incur as a result of a failure by you to comply with your obligations under these terms and conditions, including without limitation, third party charges which are raised for your account as a result of a failure to adhere to your obligations regarding removal of SIM cards and other data..

We do not exclude or limit in any way our liability for:

death or personal injury caused by Our negligence or the negligence of Our employees, agents or subcontractors;
raud or fraudulent misrepresentation;
breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession); and
breach of the terms implied by sections 3, 4 and 5 of the Supply of Goods and Services Act 1982 (description, satisfactory quality, fitness for purpose and samples).
